In 2023, voters in Ohio approved the legalization of marijuana, establishing a regulatory framework to guide the state’s implementation process. The finalized legislation, Senate Bill 56, outlines updated provisions for both marijuana and intoxicating hemp products. Sponsored by State Senator Steve Huffman (R-Tipp City), the bill was approved by both chambers following an extended legislative process. Huffman emphasized that the law balances voter intent with safeguards designed to protect minors and ensure appropriate oversight of the industry.
The legislation places the adult-use marijuana program under the authority of the Division of Cannabis Control, which also oversees the state’s medical program. It limits the number of dispensaries to 400 statewide, requires a one-mile distance between locations, and prohibits establishments within 500 feet of schools, playgrounds, or churches. The bill also restricts the sale of unregulated intoxicating hemp products and aligns with federal actions redefining THC thresholds. Although initially permitting THC beverages, this provision was vetoed by Governor Mike DeWine.
